Preamble

By registering as a member on Quomi you accept the following terms and conditions of Quomi (hereinafter referred to as "TCs").

Quomi is part of the „European Medical Service Network“  (hereinafter referred to as „EMSN“).
https://quomiforpatients.com and other country domains and sub domains belong to EMSN.

Quomi sees itself as a medically relevant service network and is directed exclusively to persons of legal age in the field of healthcare.

The member can (we recommend to do this) print and download or save the TCs at any time, even after the contractual phase has been agreed to by registering, from the accessible link „Terms and Conditions“ (TCs) on all Quomi-websites.

1. Purpose

1.1 Quomi offers its members a networking platform for health care matters, as a closed, free contact-, information-, training-, and business forum as well as social networking.

1.2 A "Verified Premium Membership" will be applied in the future (in the course referred to as "VPM"). Further details regarding the "VPM" will be made available to all members in due  time via email, as well as a modification in the TCs.

1.3 Use of the Quomi platform, which exceeds the initial offer of services and content generated by Quomi, requires the prior written consent of Quomi.
 

1.4 The member hereby acknowledges that a stable and constant availability of the Quomi-Websites are technically impossible.  Of course Quomi strives to provide the best availability possible. Maintenance, security or capacity issues, as well as events outside the control of Quomi (e.g. such as disruption of internal and public communications networks, power outages, etc.), can lead to   disorders or short-term cessation of services on the Quomi-Websites.

1.7. Quomi provides merely a networking platform. The communication among the members runs autonomously without any involvement by Quomi.

2. Registration

2.1 Considering the medical base of Quomi, all members registering should/must  be affiliated directly with a professional  aspect of health care. Only such people and companies are allowed to register. The member warrants that the data he / she provided during the registration are correct and accurate. Quomi holds the right, in case of doubt, to demand written proof of the accuracy of the information.

2.2 Each member shall adjust any changes in his/her registration data without undue delay.

2.3 Each member may only register once and create only one profile.

2.4 During registration each member chooses his/her own password. He/she is obligated to keep the password secret. The use, as well as the writing of articles or entries in forums, using a pseudonym is generally allowed. The registration data is only known to Quomi. On the Quomi websites, personal registration details will not be visible to other members at any time, unless you allow it. Quomi will under no circumstance pass a members’ password on to third parties and shall never ask their member for his/her password.
2.5 Given the current  technical possibilities, there is no secure method for Quomi available to determine whether a registered member on Quomi is actually the person he or she portrays to be under the registered profile and data. Quomi can and will therefore provide no guarantee for the actual identity of a member. Each member is therefore obligated to assure himself of the identity of another member.
 

3. Uses
3.1 Quomi reserves itself all rights to the platform offered at any time, wholly or partly, temporarily or permanently, to modify, delete or discontinue the use of the platform without any previous notice or reason.
3.2 Furthermore, Quomi reserves itself the right to suspend contributions or remove/exclude members without notice or argumentation. This is especially true if a violation of the Terms of Use has been established.
3.3 The member may only upload photos of his/her person to the profile, that are not older than five (5) years old and clearly identifies the member. Uploading of photos or images of any other person than of the member, or of other non-existent people or other beings (animals, fantasy beings, etc.) in the profile is not allowed.
 

3.4 In particular, members shall refrain from:


a) usage of offensive or defamatory content, regardless of whom or what it involves


b) using or distributing pornographic material or any content that violates any applied legislation for the protection of minors

c) to annoy and harass other users (particularly through SPAM) (cf. § Section 7 of the German Unfair Competition Act),

d) usage, without proof of authorization, of legally protected content (e.g. by copyright, trademark, patent, design or utility model rights), or to advertise, offer or distribute legally protected goods or services

e) instigate or be part of commercial practices considered unfair competition, including progressive customer advertising (e.g. chains distribution systems, snowball systems or pyramid schemes).


4. Any dubious activities shall be omitted, even if they do not directly violate laws:

a) chain letters

b) implementation, application and promotion of structural distribution measures (such as multi-level marketing or multi level network marketing)

c) Sexually embossed communications (explicitly or implicitly) or even offensive remarks.

5. The following acts are prohibited for members:

a) use of mechanisms, software or scripts in connection with the Quomi network, blocking, overwriting, modifying, copying, unless such disclosure is explicitly authorized in writing. Copying through use of "robot / crawler" search-engine technologies is not required for the proper functionality of the services offered and is herewith strictly prohibited.

b) Publicly disclosing and distributing information and contents from any Quomi-Websites or any other member.

6. Warranty

6.1 Quomi assumes no responsibility for the topicality, correctness, completeness or quality of the member  posts and uploads, particularly not for content linked on external websites. Furthermore Quomi will assume no warranty that the contents are true, or serving a specific purpose.

6.2. Members may report any activities of any other member who violate applicable laws and/or any of the terms and conditions of these TCs using the contact form available at all Quomi Web sites.

7. Termination of the contract

1. Members may terminate their free membership at any time without an explanation  or notice. Termination may be done by using the contact icons which can be found on all Quomi-Websites stating the members name and email details.

At termination, the member name and the members registered e-mail address will be removed. The practice of the extraordinary termination rights remain unaffected.

2. Quomi reserves itself the right to terminate a membership or profile without any due notice in case of suspicious activity by that member or violating the TCs.


  8. Liability of Quomi

On whatever the legal grounds, liability for damage claims based only on ordinary negligence against Quomi (including its contracted agents) shall exist only if a breach of basic/cardinal obligations was commited by Quomi under this agreement. In such an unthinkable event, the amount of claims are limited to typical and foreseeable damages.

This shall not affect personal injury and property damage claims which are based on the German Product Liability Act.


9. Rights granted by the member

Uploads, posts, articles and data, apart from personal data, placed by members on the Quomi-Network,  grant Quomi a free and irrevocable right to a simple use of such content. This usage is neither timely, nor territorially limited.

10. Final provisions

1. All statements in the context of anticipated or completed Quomi license shall be done in writing or by e-mail via the contact form on all Quomi-Websites. 

2. Quomi reserves the right to change these Terms at any time without further explanation to change. The member shall be informed of changes within the GTC timely information. If members do not object in written form within 2 weeks after notification of the amended TCs, they shall be applied and updated to the terms as approved by the member.


3. Should individual provisions of these TCs be or become invalid or weakened, the effectiveness of the remaining provisions shall not be affected.
 

4. German law applies to the exclusion of the CISG.
